The mandate of the International Centre for Settlement of Investment Disputes (ICSID) is to foster increased flows of international investment by providing an impartial and effective international forum for the resolution of disputes between host governments and foreign investors. Roles & Responsibility:
The MNA Fellow will be assigned to the ICSID Secretariat’s Front Office. They will work under the supervision of an ICSID Counsel and the general guidance of the Deputy Secretary-General and Secretary General. The MNA Fellow will work on matters arising out of the governance of ICSID as an international institution, including legal research on governance matters, helping prepare presentations and other institutional projects. The MNA Fellow will also provide support in proceedings. The position requires strong verbal and written communication skills in English and Arabic.
Governance Matters
• Undertake and assist in drafting research documents and memos on arbitration, conciliation, alternate dispute resolution and foreign investment law, with a regional emphasis on developments in the Middle East and North Africa (MENA).
• Provide assistance in engaging with member States and other key stakeholders by preparing briefing materials, supporting communications, and contributing to the organization of conferences, workshops and training events related to dispute resolution and foreign investment.
• Monitor and analyze updates to investment and arbitration laws, bilateral investment treaties (BITs), and policy shifts impacting foreign investment in the region.
• Review and synthesize national legal instruments, international conventions and case law relevant to dispute resolution and foreign investment.
• Assist ICSID management with developing and implementing institutional policies and procedures about ICSID Convention membership.
• Assist with ongoing projects and other special initiatives.
• Assist with the maintenance and management of ICSID’s institutional archives.
• Assist management and other counsel with the drafting of speeches and publications.
• Draft institutional correspondence and announcements.
• Work on other matters, initiatives and programs as the Secretary-General, Deputy Secretary-General or Team Leaders may assign.
Arbitration and Conciliation Proceedings
• Draft, format, proofread and finalize case-related correspondence in English and/or Arabic ensuring consistency with institutional standards.
• Prepare initial drafts of case documents in cases for review by the ICSID Deputy Secretary-General and ICSID legal counsel.
• File submissions and other case-related documents in ICSID’s document management system in accordance with ICSID’s information management standards and procedures.
• Track and maintain case procedural details and milestones up to date in ICSID’s case tracking systems and external website.
• Create and maintain calendars of events (i.e., pending actions) for each case and the team.
• Research assigned issues using existing case files and alternative sources (e.g., the internet, online portals or other databases), analyze information and summarize findings.
• Prepare budget estimates for cases to ensure sufficient funds in the case escrow accounts.
• Prepare letters to parties requesting advances on costs and monitor the financial position of case escrow accounts.
• Coordinate with the Secretariat’s Administration and Finance Team on the closure of case escrow accounts at the end of each case and on fund balance refunds when appropriate.
• Provide editing assistance with awards and decisions (e.g., tables of contents, footnotes).
• Assist with the logistical arrangements for remote, hybrid and in-person hearings in Washington, D.C. and abroad by preparing lists of participants and assembling all hearing-related documents, among other things. Serve as backup to the Secretariat’s Hearings Organizer and Assistant.
Selection Criteria
• Advanced degree in law (JD, LLM or equivalent) and at least two years of relevant experience.
• Knowledge of international investment law and public international law.
• Knowledge of arbitration practice and procedure.
• Experience editing publications or working on a law journal would be an advantage.
• Excellent skills in organizing, prioritizing and coordinating work.
• Capacity to deliver a substantial and proficient level of work independently.
• Sense of responsibility, integrity and positive attitude.
